1. Terms & Conditions of Use

These Terms of Use ("Terms") govern your access to and use of the Danza Pass website, applications, and related services (collectively, the "Services") offered by the operator of Danza Pass ("we", "us", or "our"). Together with our Privacy Policy and any other policies we post on the Services, these Terms form a binding agreement between you and us.

By creating an account, purchasing tickets, listing or managing events, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who we are

The Services are operated by the legal entity responsible for the Danza Pass platform. For notices required under applicable law, and for general inquiries about these Terms, you may contact us through the channels listed on our Contact page. We may update identification details (registered name, address, registration number) on this page from time to time without changing the substance of the Terms.

2. What the Services are

Danza Pass provides tools to discover festivals and events, create and manage organizer accounts, sell or distribute tickets or passes, and related features such as communications, reporting, and account management. Unless expressly stated otherwise, we act as a technology platform and intermediary between event organizers ("Organizers") and attendees or buyers ("Attendees").

Organizers are solely responsible for their events, pricing, capacity, admission rules, health and safety, compliance with local laws, and the accuracy of listings. We are not the promoter or organizer of third-party events unless we expressly identify ourselves as such for a specific event.

3. Eligibility and accounts

You must be at least the age of majority in your jurisdiction (or, if younger, use the Services only with verifiable parental or guardian consent where required) to enter into these Terms. You agree that registration information you provide is accurate and current, and that you will keep it updated.

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access. We may refuse registration, suspend, or terminate accounts that violate these Terms or pose a security or legal risk.

4. Organizer obligations

If you publish events or sell tickets through the Services, you represent that you have the rights and permissions to do so, including any venue agreements, intellectual property, and tax obligations. You must clearly communicate refund, cancellation, and entry policies to Attendees in accordance with applicable law and our policies.

You must not use the Services to list fraudulent events, mislead buyers, manipulate pricing or inventory, or circumvent fees owed to us or to payment partners where applicable.

5. Tickets, orders, and payments

When you purchase tickets or passes, you enter into a contract with the Organizer for the event (and, where applicable, with us only for platform and payment facilitation). Payment processing may be handled by third-party payment service providers; their terms and privacy notices also apply.

Refunds and disputes are generally governed by the Organizer's stated policies and applicable law. Unless we expressly communicate otherwise for a given transaction, we are not obligated to provide refunds beyond what the Organizer authorizes or what is required by law.

6. Acceptable use

You agree not to:

  • Violate any law or infringe others' rights;
  • Upload malware, scrape or overload the Services, or attempt unauthorized access;
  • Harass, defraud, or impersonate others;
  • Use the Services to send unsolicited bulk communications without consent;
  • Reverse engineer or attempt to extract source code or models except where permitted by law.

7. Intellectual property

We and our licensors own the Services, including software, branding, and content we create. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You retain ownership of content you submit; you grant us a license to host, display, and process that content as needed to operate and improve the Services and to comply with law.

8. Disclaimers

The Services are provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation or that events will occur as listed.

9. Limitation of liability

To the maximum extent permitted by applicable law, we (and our affiliates, directors, and employees) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Services will not exceed the greater of (a) amounts you paid us in fees for the Services in the twelve (12) months before the claim, or (b) one hundred euros (€100), except where such a cap is prohibited by law.

10. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your events or listings, your violation of these Terms, or your violation of third-party rights.

11. Suspension and termination

We may suspend or terminate access to the Services at any time for breach of these Terms, risk to the platform, legal requirements, or other legitimate reasons. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operating entity is established, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive jurisdiction, unless mandatory consumer protection laws in your country give you the right to bring claims elsewhere. If you are a consumer in the EEA or UK, nothing in these Terms limits your statutory rights.

13. Changes

We may modify these Terms by posting an updated version on this page and revising the "Last updated" date. Material changes may require additional notice where required by law. Continued use after changes become effective constitutes acceptance unless applicable law requires a different process.
